Rewa posted 7 collectors: HC Notice on Encroachment in ponds
The Madhya Pradesh High Court has taken serious note of non-removal of encroachments from the ponds of Rewa district despite the order. While hearing the contempt petition, the High Court’s Jugalpeeth of Chief Justice Ravi Vijay Kumar Malimath and Justice Vishal Mishra has issued notices to the seven district collectors posted since 2014 and sought answers. The next hearing on the petition has been fixed after four weeks.
Collectors had ignored the order of the court:
In the contempt petition filed by the petitioner Shyamanandan Mishra, it was said that earlier he had filed a petition in the High Court demanding protection of the ponds of Rewa district. While hearing the petition, the High Court ordered the District Collector to remove encroachments from all the ponds in Rewa district and stop illegal mining. The High Court had set a date of 31 March 2014 for this. Apart from this, orders were also issued to present the Action Taken Report to the District Collector. The said contempt petition was filed in the year 2014 due to non-compliance of the order of the High Court.
There seems to be gross contempt of order:
During the last hearing, the couple had said that the order of the High Court had not been implemented by the District Collector. Taking this seriously, the Jugalpeeth said in its order that there seems to be gross contempt on the part of all the Collectors posted since January 16, 2014. The Jugalpeeth had directed to present the list of names of all the collectors posted during this tenure.
During the hearing, it was told by the government that encroachments have not been removed from 15 ponds. Apart from this, a list of the names of the collectors was also presented before the Jugalpeeth. Making all the collectors non-applicants in the petition, the Jugal Peeth has asked why contempt proceedings should not be initiated against them. The non-applicant collectors have been given four weeks time to submit their reply. Advocate Nityanand Mishra appeared on behalf of the petitioner.
